Amid growing dissent, will Canada change its immigration plans?

Canada is set to unveil the latest targets for how many new residents it hopes to welcome in the coming years.

The annual announcement of permanent resident levels, something Immigration Minister Marc Miller must do in Parliament on or before Nov. 1, is the kind of dry fare that has traditionally drawn little attention, serving largely as a governmental formality amid high levels of public support for immigration.

But this year’s numbers are expected to face more scrutiny given a surging discussion of whether Canada has the capacity and the infrastructure it needs to accommodate the hundreds of thousands of newcomers it is bringing in.

And, as the government seeks to maintain public support for immigration, some say how Prime Minister Justin Trudeau’s Liberals approach immigration — and the messaging around it — will be key.

The government’s current immigration plan, unveiled in 2022, aimed to bring in 465,000 new permanent residents this year, 485,000 in 2024 and 500,000 in 2025. The immigration ministry is on track to meet the 2023 target.

The upcoming plan, however, will look at the numbers for the next three years.

Recent polls suggest that Canadians’ appetite for more immigration may be waning. A Nanos report in September showed 53 per cent of Canadians wanted Ottawa to accept fewer immigrants, up from 34 per cent in a similar poll in March. Then, an online survey by Research Co. in October found 38 per cent of Canadians said they believe immigration is having a mostly negative effect, up 12 percentage points from research conducted a year ago.

“Some people are feeling there’s too much immigration, when it comes to the fact that it’s driving up the housing cost, exacerbating the housing shortage, making the connection between immigration and health care and education,” says Toronto Metropolitan University professor Rupa Banerjee, whose research focuses on immigrant employment integration.

“Immigration is on people’s radar more and the plan will be scrutinized a lot more closely.”

So far, the government has seemed inclined to stay the course.

“I don’t see a world in which we lower it, the need is too great,” Miller told Bloomberg in August. “Whether we revise them upwards or not is something that I have to look at.”

Magdalene Cooman of the Conference Board of Canada said Canadians need to understand the immigration plan’s long-term objectives are to address the country’s aging population and boost economic growth.

While immigrants do need housing, health care and other government services, she said, people shouldn’t lose sight of the fact that newcomers are also part of the solutions to those challenges, and contribute to the workforce, whether it’s by building new homes or caring for those in hospitals.

“There is a reason why the federal government has moved in this direction,” said Cooman, the board’s interim associate director in charge of immigration research.

“Immigration is really the only way to increase population, to support population growth and to support the future of Canada.”

A recent report by Desjardins said the country’s working-age population (those 15 to 64) would need to grow by just over two per cent annually in order to offset the impacts of aging. That growth relies largely on immigration.

“What’s the optimal level of immigration to Canada? This can be a tough question to answer, as ‘optimal’ is in the eye of the beholder,” said the report. “It depends on the policy objective that immigration is meant to achieve.”

While the short-term strains of the population growth are already showing, the report suggested the federal government could restrict the admission of non-permanent residents such as international students and temporary foreign workers.

Despite the lagging infrastructure, the conference board’s Cooman warned that any pause to the long-term immigration strategy could create other unintended problems.

“I’m not opposed to increasing the levels because I understand the long-term growth strategy,” said Cooman. “But I am opposed to increasing the levels without a strategy to show us how all the infrastructure can be built to accommodate more people in the country. You can’t have one without the other.”

Whom Canada brings in matters, observers say.

Permanent residents come to Canada under the economic, family or humanitarian classes. In 2023, about 58 per cent of them will have been selected based on their education backgrounds and skills; 23 per cent through sponsorships by spouses or children and grandchildren; and the rest as resettled refugees and protected persons.

Using real wages as a proxy for relative productivity of different groups, the Desjardins report said economic immigrants in particular are outperforming the typical Canadian.

Several observers credit the immigration ministry with fine-tuning the way it selects economic immigrants by better matching the skills of candidates with the labour market needs, and targeting those with backgrounds in health care, transportation, trades, agriculture and STEM occupations. Officials, for instance, have relaxed some rules for immigrant physicians and created a special immigrant class to attract workers in construction-related trades.

To immigration lawyer Betsy Kane, the bigger challenge for Miller is to overcome the public backlash and explain his immigration strategy.

“Between the home construction effort and the easing of the doctor efforts, you’re potentially reducing the lag in public opinion,” said Kane, vice-president of the Canadian Immigration Lawyers Association.

Banerjee of TMU said the government has to be more specific in explaining the immigration plan than just floating the big numbers around.

“We are bringing in trades and transport workers and there’s a number of pilots now that are working to try and bring people into underserviced smaller and rural communities. Many of them are very small (scaled), but there’s been efforts,” said Banerjee.

“A lot of that is lost, because all we see in the headlines is ‘500,000 newcomers being admitted.’”

In August, a CIBC study found there were about one million more people living in Canada than official government estimates, including international students, foreign workers, asylum seekers and undocumented migrants. (Unlike permanent residents, temporary residents are uncapped and not included in the immigration plan.)

“We need to make sure these immigration targets also include temporary migration numbers. We cannot have uncapped temporary migration and then pretend that is all of the immigration,” said Banerjee.

In a letter to Miller this month, the Business Council of Canada urged the government to prioritize highly skilled economic-class immigrants to fill high-paying jobs, and raise the ratio of the economic immigrants in the mix from 60 per cent to 65 per cent by 2025.

While the number of job vacancies requiring lower levels of skill and education has declined significantly, the council said unfilled job openings for highly trained and educated professionals remain stubbornly high.

“Enhanced economic immigration is essential,” wrote Goldy Hyder, president and CEO of the council, whose member companies support more than six million jobs across Canada. “If we do not seek this skilled labour, our economic rivals will.”

But employers aren’t the only group that would like to get a bigger piece of the permanent-resident pie.

Advocates for refugees are urging Ottawa to raise the levels of resettled refugees up from about 10 per cent to 15 per cent to accommodate the growing number of displaced migrants around the world, which now stands at 108 million.

“If we are able to increase Canada’s resettlement targets, it would support the reduction of the backlog,” said Gauri Sreenivasan of the Canadian Council for Refugees, adding that a recent government audit showed 99,000 refugees were waiting in the queue by December 2022.

NDP immigration critic Jenny Kwan said she’s concerned about the backlash against the immigrant community.

“No good will come out of that because we have already lived through racism and discrimination in Canada’s history,” she said. “The government has to have a housing plan and an infrastructure plan for our community.”

Tom Kmiec, the Conservative immigration critic, did not respond to the Star’s requests for comment. This summer, his party leader, Pierre Poilievre, did say the immigration system is broken, but sidestepped reporters’ questions about whether he would change the current targets.

‘Culling’ bad actors capitalizing on tuition fees more effective than capping student visas in bid to fix housing crisis: immigration lawyer

As politicians trade shots over who is to blame for Canada’s housing crisis, immigration lawyer Betsy Kane says “the finger-pointing” should be aimed at the schools actively recruiting “anyone and everyone who has the money to get here” without ensuring an adequate supply of student housing. Rather than capping the number of student visas, she says the government should instead tighten the criteria under which institutions are permitted to host them.  

However, NDP housing and immigration critic Jenny Kwan (Vancouver East, B.C.) says a cap would simply be more of the Liberals “tinkering around the edges” of the housing crisis, and “if they want to point fingers, they should look at themselves in the mirror,” and admit that their current housing strategy is, at best, inefficient, and, at worst, a failure.

On Aug. 21, during the Liberals’ cabinet retreat in Prince Edward Island, Housing Minister Sean Fraser (Central Nova, N.S.) suggested the federal government may need to consider a cap on its international student program, which has seen “explosive growth” since the Liberals took office in 2015. 

Currently, there are more than 807,000 international students with study permits in Canada, up from 352,330 in 2015.

“There are good private institutions out there, and separating the wheat from the chaff is going to be a big focus of the work that I try to do with [Immigration Minister Marc] Miller,” Fraser said, adding that “when you see some of these institutions that have five, six times as many students enrolled as they have spaces for them in the building … you’ve got to start to ask yourself some pretty tough questions.”

In an interview with CBC’s The House later that weekImmigration Minister Marc Miller (Ville-Marie–Le Sud-Ouest–Île-des-Soeurs, Que.) said Canada is on track to host around 900,000 international students this year, and while he did not commit to Fraser’s suggestion, he said a cap was not “the only solution to this.” 

Miller also cast blame on a number of “illegitimate actors” exploiting the system, and while he declined to “name and shame,” he said many of those actors were within the private market.

While Fraser cautioned against blaming newcomers for “housing challenges that have been several decades in the making,” Conservative Leader Pierre Poilievre (Carleton, Ont.) accused the Liberals of doing just that.

“[Prime Minister Justin Trudeau] thinks if you’re afraid of your neighbours, you might forget that you can’t pay your rent. This is what demagogues do,” Poilievre said at an Aug. 23 press conference on Parliament Hill. “He wants Canadians to forget all that and blame immigrants. He wants to divide people to distract from his failings.”

Kane, vice-president of government relations with the Canadian Immigration Lawyer Association, told The Hill Times it was “a bit unfair” to blame the high number of international students for putting pressure on the housing market.

“What we’re seeing is the result of colleges and universities leveraging the International Student Program in order to capitalize on the tuition that they’re able to charge,” Kane said. “As Minister Fraser said, we need to cut ‘the wheat from the chaff’ and figure out which institutions aren’t attempting to deliver high-quality education but rather to capitalize on the higher tuition fees.”

Kane said the government could reduce the number of students in other ways, including narrowing the eligibility or designating so-called “trusted educational institutions” that can demonstrate they are delivering programming that can translate to valuable labour market skills and job opportunities.

“By culling the number of institutions and increasing the financial wherewithal students must demonstrate to qualify, you’re in essence capping the number without capping all international students,” Kane explained, adding that the government could also look to tighten further the criteria for which programs of study are eligible to receive applications by international students.

“We don’t necessarily need more international graduates with a one- or two-year business administration diploma,” Kane said. “But we do need graduates in the trades and transportation.”

Additionally, Kane said those institutions should have a greater responsibility to ensure that there is sufficient housing to accommodate students, pointing to similar responsibilities imposed on employers looking to bring in temporary foreign workers. 

Kane also noted that a cap on international students and the Liberals’ targets for new permanent residents were “two different sides of the [immigration] coin.”

“There’s always a risk of a backlash to any type of newcomer … but many of the cohort of individuals being selected as permanent residents are already here as workers and students who can demonstrate that their education, language skills, and work experience will translate into helping our economy,” Kane explained. “So what the government is saying is that in favour of letting us achieve our overall permanent immigration goals, we may have to limit the intake of our temporary residents.”

‘Collision’ between increased immigration and housing market stress ‘a major risk’ for Liberals, says pollster Nanos

While a plurality of Canadians have historically supported greater immigration, Nik Nanos, CEO and chief data scientist for Nanos Research, said that a recent survey conducted by Nanos between July 30 and Aug. 3 for Bloomberg News suggests a majority of Canadians believe increasing the annual immigration targets from 465,000 in 2023 to 500,000 by 2025 would have a negative (42 per cent) or somewhat negative (26 per cent) impact on housing prices. Only one in five believe it will have a positive (eight per cent) or somewhat positive impact (12 per cent).

“Canadians are not against immigration, but they do understand that when you bring over [400,000] to 500,000 new people into the country every year, they have to live someplace,” Nanos told The Hill Times, comparing the immigration targets to adding the population of cities like Kitchener, Ont., every year.

“These are pretty significant numbers,” Nanos continued, adding that the average Canadian doesn’t need to be an expert on immigration or housing to know that those newcomers are going to put more pressure on the market.

According to the Canada Mortgage and Housing Corporation (CMHC), Canada needs to build 5.8 million new homes by 2030 to tackle housing affordability. The current pace of building puts the country on track to construct just 2.3 million homes by then.

“I think the collision of increasing the number of immigrants and the stress on housing is a major risk for the Liberals,” Nanos said, adding that the Liberals are primarily responsible for putting the two issues on their current path.

“The Liberals created this policy, so they have to take responsibility for the repercussions in terms of pressure on housing and other social welfare programs,” Nanos continued. “They need to work with the provinces and municipalities in order for this policy of bringing in more newcomers to work well and to have the least amount of disruption.”

‘Pointing fingers’ at newcomers, students no substitute for effective housing strategy, says NDP MP Kwan

Kwan called the apparent “change in tune” from Fraser since being sworn in “disconcerting.” While speaking to reporters outside Rideau Hall on July 26, Fraser “[urged] caution to anyone who believes the answer to our housing challenges is to close the door on newcomers.” Kwan said that trying to divert blame to any one group in need of housing is not the solution. 

“The problem is not new people; the problem is the government and a lack of programs and measures that need to be in place to provide housing to both Canadians and newcomers alike,” Kwan said. “Unless [the Liberals] face the music and admit what they are doing is deficient, and in some cases a complete failure, we’re going to keep having this problem.”

However, it is not just the current Liberal government that Kwan says bears responsibility for the current housing crisis, pointing to the actions of consecutive governments of both stripes in the early 1990s—first the Progressive Conservative government under Brian Mulroney and then Jean Chrétien’s Liberals—who began reducing spending on housing, and cut the federal co-operative housing program before eventually pulling the plug on building any new affordable housing units entirely.

Rather than capping the number of international students admitted into the country every year, Kwan said the government should require universities and colleges to provide affordable student housing.

“We know that international students pay exorbitant fees to apply and then pay a significant amount more in tuition fees,” Kwan said, noting the schools had come to rely on that source of income due to a lack of sufficient funding from the provinces.

Kwan said the federal government should play an equal partner with the provinces and schools in funding those student accommodations, and also suggested the Liberals could tie the number of permits an institution could receive to the number of homes they can actually provide.

However, Kwan said that would simply be more “tinkering around the edges” of the problem.

“What we need is the government to deliver on a real housing plan, and that means taking bold action to make real investments,” Kwan said, noting that the federal auditor general’s November 2022 report on the National Housing Strategy provided “riches of embarrassment.” 

She also pointed to testimony from CMHC president Romy Bowers at a Dec. 5, 2022, House Human Resources, Skills, and Social Development Committee meeting, where Bowers said the CMHC’s goal of all Canadians having a “home they can afford and [that] meets their needs” by 2030 is “aspirational.”

“It’s like our moonshot. It’s like our North Star that guides our activity. It’s likely that we’re not going to achieve it, but we feel that there’s a lot of value in trying for it,” Bowers told the committee.

Kwan said if that was Canada’s approach to homelessness and the housing crisis, “it isn’t a wonder that we’re failing.”

“[The NDP] is calling on the government to build more social housing, co-op housing, and community housing that once upon a time was built by the federal government, and we need to get back to doing that,” Kwan said, noting that building was only half of the solution. 

The second half would require increased efforts to safeguard the dwindling stock that Canada has left.

“Canada is losing low-cost rental housing stock to financialized landlords, buying up low-cost rental apartments only to subsequently reno- or demo-evict the current tenants,” Kwan explained, pointing to a recent study by Steve Pomeroy, a housing research consultant and senior research fellow in the Centre for Urban Research and Education at Carleton University. 

Pomeroy’s study found that while the National Housing Strategy included plans to build 16,000 new affordable units per year, four existing units were lost for every unit built. 

“We can’t build fast enough if that rate of loss is allowed to continue,” Kwan said. “We have to stop the bleeding.” 

The NDP is calling on the federal government to create an acquisition fund for non-profits to hold existing stock in a land trust in perpetuity, as well as a moratorium on acquiring those units by “financialized landlords.” Kwan said that Canada could follow the lead of nations like New Zealand that have introduced mortgage “escalators” that increase the required down payment on second and third homes, which would also have the added benefit of levelling the playing field for first-time home buyers.

“To fix the housing crisis, the right to housing needs to be principal, and the government needs to ensure they have a plan commensurate with that to deliver,” Kwan continued. “Minister Fraser said everything is on the table, and there’s no rock he won’t turn … how about tackling the hard stuff and not tinkering around the edges?”

Canada pausing intake of highly skilled immigrant workers amid heavy backlog

The former was a policy choice in order to meet the government’s fixation on meeting its target of 401,000; the latter reflected lack of foresight, common to many countries, and thus the need to deal with the crisis:

Canada’s immigration system for high-skilled workers is severely backlogged and even amidst a labour shortage, the government is pausing new invitations because the department simply can’t process them quickly enough, according to a briefing document.

Immigration lawyer Steven Meurrens obtained the document through access to information and provided it to the National Post. In the memo, department officials outline that “an estimated 76,000” applicants are in the inventory for federal high-skilled worker applications, which is more than what the government needs to meet targets all the way out to 2023.

The same memo says the express entry pool, which includes skilled workers, skilled trades and people with experience living in Canada, has more than 207,000 people in it.

Canada’s immigration plan has a variety of different classes, including skilled workers, provincial nominees, family reunification and refugees. The government has continued to process applicants nominated by the provinces, but other economic immigrants have been stalled since last fall.

People applying through the high skilled worker and trades program submit a variety of documents including a language test and then wait for an invitation to finish their application before it is processed.

With travel bans in place, high-skilled worker applications from overseas have been on pause since September 2021. Last year, the government still managed to hit its record-high immigration targets, but did so mostly by inviting people already in Canada on temporary permits or as students to become permanent residents through a new temporary resident to permanent resident program (TR2PR).

The government’s current immigration plan forecasts bringing in 110,500 skilled workers next year, but the department says in a memo that could have to be cut by as much as half, because the department has so much other work.

“These reductions are due to admissions space required to accommodate the TR2PR stream and the resettlement of Afghan nationals to Canada,” reads the memo.

The Liberals initially pledged to bring 20,000 Afghans to Canada, but during the fall campaign doubled the pledge to 40,000. As of the most recent update 7,000 of them have arrived in Canada.

A new departmental immigration plan will be tabled in Parliament when the House of Commons resumes in February.

The department aims for a six-month processing time for federal skilled workers (FSW), but in the memo they warned that could rise dramatically.

“Processing times are currently at 20.4 months (over three times higher than the service standard) and are expected to continue to grow as older inventory is processed. The FSW processing time is expected to rise to 36 months throughout 2022.”

Immigration Minister Sean Fraser was not available for an interview, but Rémi Larivière, a spokeswoman for the department, said the government will still bring in highly skilled workers, because so many are already in the queue.

“The already existing robust inventory of skilled candidates to process means that there won’t be a reduction in 2022 of the number of new skilled permanent residents arriving in Canada to work and settle,” she said in an email. “This pause is temporary; invitations to apply under the FHS streams will resume once the processing inventory is reduced enough to create space for new intake.”

Larivière said the fall fiscal update included measures to help reduce the backlog.

“The Government of Canada has proposed to provide $85 million in 2022-23 so it can process more permanent and temporary resident applications and reduce processing times in key areas affected by the pandemic.”

Conservative MP Jasraj Singh Hallan, the party’s immigration critic, said the delays are unacceptable.

“The massive backlog the Liberal government has created at Immigration, Refugees and Citizenship Canada is not only hurting hard-working newcomers, families, immigrants and business owners, it also threatens billions of dollars of much-needed economic growth in Canada,” he said in a statement.

He said employers need workers and the government has to act quickly.

“Immigrants and Canadian employers cannot wait three years to have Federal Skilled Worker applications processed. It’s time for the Liberals to announce a precise date for when the pause on processing federal skilled worker invitations will come to an end.”

A Business Development Bank of Canada study from last fall found 55 per cent of Canadian businesses were dealing with labour shortages. They found that number was as high as 80 per cent in hospitality type businesses.

Potential immigrants to Canada are scored based on their level of education, language proficiency and other measures under the government’s Comprehensive Ranking System. The memo outlines that with the current state of applications someone would need a score over 500.

Betsy Kane, an Ottawa Immigration lawyer, said that is a very high score.

“What that’s going to mean is basically a young couple with very high education for both applicant and the person concerned, potentially only with executive-type job offers,” she said. “What it’s telling you is that only basically power couples are going to be who’s going to benefit from the 500-plus scores.”

Kane said with this backlog there are also going to be a lot of people on work or study permits who will need extensions because their application hasn’t been processed.

The federal Liberals have set targets to bring in more than 400,000 immigrants a year. Kane said they need more than lofty goals.

”The department has the capacity to do it. It just needs tools.”

She said that should include getting people back into the office to process applications, many of which come in on paper.

“This department is an essential service just like Canada Revenue Agency and just like the Canada Border Services Agency,” she said. “These guys should be back in the office.”

Sergio Karas, a Toronto immigration lawyer, said the department also has to start focusing more on what Canada’s employers need.

“I don’t think it’s a matter of adding personnel. I think it’s a matter of realigning priorities, and reassigning personnel to process the type of applications that the Canadian economy requires,” he said. “Employers are desperate for skilled trades for people who are highly skilled typically in the construction industry.”

Canada trumpeted its special, one-time immigration program for international grads and essential workers. But did it work in the end?

Some lessons here more broadly, both with respect to policy and service delivery:

Has Ottawa’s latest immigration pathway for international graduates and essential migrant workers been a success or a missed opportunity?

After much fanfare in April to announce the first-come, first-served program to grant permanent residence to temporary migrants in Canada, officials released details about the process and requirements less than 24 hours before applications opened a month ago on May 6.

The cap of 40,000 applications for international graduates here on postgraduate work permits was filled within a day, while intake for the two migrant worker streams in health and non-health sectors — with a cap of 50,000 applications — has been slow.

As of Friday, only 1,700 applications had been received under the stream for health workers out of a quota of 20,000, and just 11,900 of the 30,000 vacancies for those in non-health related jobs were filled.

That shortfall has prompted some critics to question whether the special pathway only favours those with Canadian education credentials and in higher-skilled jobs, but excludes the essential workers who don’t meet the strict language and job criteria and who really need the help.

“It’s a missed opportunity to provide a pathway to permanent residence for other ‘low-skilled’ workers who don’t qualify. … They had an opportunity to finally give all low-skilled foreign nationals pathway for permanent residence that they’d been talking about for years,” says Vancouver-based immigration lawyer Steven Meurrens.

“There are so many people here in low-skilled jobs for such a long time. It’s not clear to me why they didn’t just expand it to all low-skilled workers who are here but don’t have an (eligible) immigration program.”

International graduates who lost their jobs during the pandemic and had their postgraduate work permits expire are already eligible to renew their permits for up to 18 months due to the pandemic, said Meurrens.

“The government sold the pathway as a COVID program. They could’ve sold it that ‘these people have been working during the pandemic and we’re going to let them stay permanently,’” said Meurrens. “They could have the political will to do that. I don’t think any opposition party would attack the government for it.”

Excitement — followed by disappointment, for some

In April, Ottawa’s announcement of the new pathway made for a good news story and the pathway was well received. It came as Canada was struggling during the peak of the third wave of COVID-19 pandemic, with daily new infections averaging more than 8,500 cases.

“This new pathway to permanent residence recognizes Canada’s need for educated and experienced workers as we work toward our economic recovery,” the immigration department said in a news release.

“It also acknowledges the extraordinary service of so many essential workers during the pandemic, many of whom are newcomers to our country and have played critical roles as we fight COVID-19.”

The pathway created a frenzy among many temporary migrants with precarious status in Canada, who were faced with the uncertainty over the impact and disruption of the pandemic toward their pursuit for permanent residence here.

Jose, a failed refugee claimant from Mexico with diabetes, has braved the exposure to COVID-19 while working in a restaurant and house cleaning through the pandemic. He said he was excited when he first heard about the program, but that excitement quickly turned to disappointment when he learned the pathway wasn’t opened to all essential workers.

“I felt sad when I found out more about the new program. We have been working to support Canadians who are staying at home during the pandemic,” said Jose, who asked his last name be withheld because he has been undocumented in Canada since his asylum claim based on sexual orientation was refused in 2009.

“Many of us have no other options to stay. We have worked hard during the pandemic and we are the ones who need a special program for permanent residence,” added the 41-year-old Montreal man.

The new pathway stipulates that all applicants must be legally employed with valid work permits in Canada at the time of their application and when they are granted permanent residence. Some applicants may end up being disqualified if they fail to keep their jobs or work permit while waiting out the process.

There are also minimum English proficiency requirements based on language test results. The migrant worker streams are limited to 40 health-care occupations and 95 other essential jobs across a range of fields, such as caregiving and food production and distribution.

Communication around program falls under criticism

Ottawa lawyer Betsy Kane said immigration officials did a poor job in communicating about the specifics of the program as they rushed to roll it out.

“The execution was very poor because people didn’t even know what the requirements were. People had to prepare in real time as they were changing what actually had to be submitted. Their guide came out the day before the application was due to open,” she pointed out.

“For somebody who is unable to appreciate what the requirements are, one of the challenges is using a portal. Expecting all documents to be scanned in a beautiful fashion and uploaded in a timely basis under the gun of a quota for low-skilled workers is not realistic.”

Although the new government portal did not crash as many observers expected it to, the immigration department’s system was so overwhelmed by the number of applicants trying to pay the $1,050 application fee that it stopped working for hours on May 6.

The pathway for international graduates would have been a godsend for Sunshine Pardinan, who was laid off as a technical assistant at a dental office and unemployed for seven months at the onset of the pandemic.

The 41-year-old Filipina missed the cap for that stream because she was unable to secure the birth certificates of her four children back home as required in the application.

Fortunately, she still qualified for the nonhealth essential worker stream.

“I was blessed that I had another chance to apply or my family’s immigration dream would be crushed,” said Pardinan, who has a degree in education from Cebu and graduated from Centennial College’s one-year business foundation program in April 2020.

“I was lucky that my former employer called me back in October so I have a job and can still qualify as an essential worker. We all have been helping the economy and I hope the government can give all temporary residents a chance.”

Kane, the lawyer, said she was not surprised the cap for the international graduate stream was filled quickly, as there’s a huge demand to keep attracting international students here and the 40,000 quota accounts for less than 10 per cent of the international student population already here.

While health workers are in huge demand, many of those are tied up helping to fight the pandemic and are not in a rush to apply because they are likely going to qualify or may have already applied through a regular immigration program.

‘A mad rush’

Daniel Lantin, who just completed a two-year program in business marketing from Centennial College this spring, was already preparing to apply for permanent residence under the skilled immigration class before Ottawa announced the new pathway.

With his work experience in social media marketing for a software company, the 30-year-old from the Philippines was able to obtain all the documentation he needed, such as proof of completing his school program and police clearances. He even managed to register and take the mandatory English test before application opened.

“This pathway is a bonus. It’s a once-in-a-lifetime opportunity that they’re taking in international students who basically just graduated and have full-time work,” said Lantin, who already had an undergraduate degree and worked in marketing in the Philippines.

“We weren’t sure whether this was going to open up again. This is an opportunity that’s not given to everyone. It’s a blessing.”

However, Lantin couldn’t get his application photos professionally done because studios were closed. Instead, he included in his file a note to explain why he didn’t have a photo and hopes immigration officials will accept the reasoning.

His lawyer, Lou Janssen Dangzalan, said people were bound to miss documents and make mistakes in their submissions as they were rushed to complete applications online, sometimes without even looking at their eligibility.

“Based out of my consultation that I’ve had, a lot of people are saying that ‘I’m going to take my chances and maybe they will adjust the policy.’ They were planning to apply anyway,” said Dangzalan, who was approached by a couple of dozen applicants for help and only 14 had valid language test results.

“The 40,000 international graduates that they’ve got. They’re not going to get all of that,” he added. “It’s such a mad rush and mistakes will be made.”

‘There will be opportunities above and beyond this pathway’

Experts said it all comes down to how forgiving and flexible immigration officials are in handling that and if they would just refuse those applications outright.

During a parliamentary immigration committee meeting, officials appeared to have moved the goalpost of the new pathway when they were asked what they would do if many ended up not being qualified.

“One single application can allow two or three people (family members) to ultimately come to Canada. We can therefore hit the target of 90,000,” said Daniel Mills, assistant deputy immigration minister in operations. “It does not necessarily depend on the number of applications, but the number of people involved.”

And for those who don’t meet this program’s criteria, Marian Campbell Jarvis, assistant deputy immigration minister in policy, said, other “pathways still exist alongside this special temporary public policy that was put in place, so there will be opportunities above and beyond this pathway.”

Jarvis expects the uptake for the essential worker streams will ultimately pick up as in the case in most new immigration programs.

In an interview Friday, Immigration Minister Marco Mendicino praised the new pathway as the “broadest and most inclusive” pathway to permanent residence for essential workers in the history of the immigration system.

He said the details of the program were clearly communicated before it opened to applications and that the feedback to the pathway has been overwhelmingly positive.

“By publishing the guideline before the program even opened, we began to inform, educate and give access to clear transparent guidance, so that as people began to prepare to submit, they have the benefit of clear instructions,” Mendicino told the Star.

“The doors are still open to this program. There are spaces. There is still time.”

Mendicino also did not rule out the possibility of another, similar pathway as the pandemic continues to wreak havoc to global migration.

“We are going to make the greatest success out of this program. Once this program has concluded and we have a really clear understanding of how it has landed, we’ll be in a better position to decide. There may be other similar pathways that we should create,” he said.

A system that needs ‘overhaul’

Karen Cocq of the Migrant Workers Alliance for Change said the problem with the new pathway is that it was designed for the people who don’t need a special program to get permanent residence.

It’s evident, she said, the program privileged those who were already the most well placed to access permanent residency with the money to pay for lawyers and fees, or may already be preparing their applications with documentations handy.

“The immigration minister trotted out these highly qualified hardworking workers in health care as examples of front-line heroes the program was built to thank. But the vast majority of people the minister called out don’t need this program,” said Cocq.

“And we know so many people who work in health care in other job classifications who do need access to permanent residency simply can’t get it through the program because so many of them are working undocumented.”

She said these are just symptoms of the fundamental tenet of Canada’s current approach to immigration that’s based on transitioning temporary residents such as international students and migrant workers to become permanent residents.

“Until the immigration system stops producing temporariness, we will continue to require partial, piecemeal and inadequate solutions. This is a historic opportunity that the government has where there’s public awareness in how the system puts people in vulnerable positions,” Cocq explained.

“I think there’s public support and public appetite to see fundamental change coming out of the pandemic to see the reorganizing of the economy and of the immigration system. The government is missing an opportunity to do the overhaul of the system that’s required.”
