Some Iranians still dream of citizenship

Canada did away with gender distinctions in 1977:

In Iran, lawmakers have acted to vote against a bill that would grant citizenship to the children of Iranian mothers and non-Iranian fathers. This dampens the hopes of hundreds of thousands of people who have been deprived of their social rights because their fathers are not Iranian.

The citizenship bill, put forward by 49 signatories, was first presented to parliament’s presiding board. At an open session Sept. 20, its double urgency was approved, with 140 votes in favor and 36 against. The double urgency designation meant that it had to be put to a final vote in less than a week. The most important part of the 12-article bill was its first article, which states: “The children of marriages between Iranian women and foreign men, or men who have no nationality but have been/will be born in Iran, may be granted citizenship after reaching the age of 18 if they have resided in Iran for five consecutive years prior to making their citizenship request.”

Between 400,000 and 1 million people in Iran are estimated to lack Iranian nationality despite having an Iranian mother. The majority of these individuals were born out of so-called “temporary marriages,” known as mut’ah in Arabic and sigheh in Persian, between Iranian women and Afghan men. These men took refuge in Iran either after the Soviet occupation of Afghanistan in the 1980s, or following the Afghan civil war in the 1990s or the US-led invasion in 2001.

Mehrangiz Kar, a prominent Iranian lawyer and women’s and children’s rights activist who has faced arrest and imprisonment for her activities, told Al-Monitor: “These children and youths are deprived of educational and health facilities as well as other services that Iranian citizens benefit from, such as subsidies and the like. In a word, they have no civil rights and lack identity documents or a birth certificate.”

…Kar, the recipient of numerous international awards, told Al-Monitor that those opposed to the plan give two reasons for their stance: “It would encourage immigration and pose dangers to the country’s national, political and social security.”

President Hassan Rouhani won the 2013 presidential election thanks to the backing of women, civil society activists and supporters of equal rights. Yet, one of the main opponents of the bill was the Rouhani administration’s deputy interior minister. Voicing his ministry’s opposition to the citizenship bill, Deputy Interior Minister Hossein Ali Amiri even delivered a speech on the day the measure was put to a vote. Amiri emphasized the many difficulties such a law would create for the government if approved, while pointing out the high number of potential migrants from Iran’s neighbors due to the regional situation. “This plan will lead to an increase in immigration and illegal marriages in the country,” he said.

Before Amiri’s speech, Principlist MPs Mohammad Ali Pourmokhtar and Nader Ghazipour also spoke in opposition to the plan. Pourmokhtar’s reasoning was that it is not clear whether those who would be granted citizenship under this plan would have any emotional attachment to Iran. Meanwhile, Ghazipour challenged the “political and security” consequences of such a measure, arguing that “Iran should remain Iranian and we should not let a non-Iranian take part in elections. We must preserve Iran’s holiness.”

Kar criticized this kind of mentality and said Iran’s political system and legislative bodies should pay attention to one basic fact: “The human rights of a mother and a child are an independent issue that can only be analyzed through the foundations of human rights, and we cannot punish abandoned mothers and children in order to make up for the long-term mistakes of a political system.”

 

…The rejection of the proposed citizenship plan has not only resulted in the nationality status of hundreds of thousands of Iranian-Afghan children being left in limbo. It has also sparked criticism at a deeper level, in relation to how women are seen and their role in Iranian society. Kar said, “Gender discrimination in citizenship laws becomes evident in places where, as a result of Article 976 in the civil law, blood linkage is only realized through the father, and maternal linkage has no effect.”

Iran’s Surprising New Foreign Legion

Ironic. Follows US approach of granting preference to those who serve in the military, which Canada also adopted in the 2014 Citizenship Act changes:

Proposed amendments to Iran’s Civil Code under the name “Facilitating Naturalization of non-Iranian Veterans, Warriors and Elites” will offer citizenship to foreigners who join Iranian military units—be it border patrol, militias confronting the so-called “Islamic State” in Iraq and Syria, groups involved with public order operations, or any of Iran’s less “official” military initiatives, including support for Hezbollah in Lebanon. Under the amendments, “revolutionary heroes” can become citizens without undergoing existing naturalization requirements.

Parliamentarians who signed the bill say those who “serve the revolution,” including people who have contributed to Iran’s scientific progress, will be entitled to easier access to the citizenship they deserve. Yet human-rights activists and lawyers say the amendments are part of a political and militaristic strategy to entice immigrants, who have resided illegally in the country since 1979, into fighting Iran’s proxy wars.

If passed, the amendment to Article 980 will allow a new working group—the Committee for Granting Naturalization to non-Iranian Veterans, Warriors and Elites—to decide if a non-Iranian “revolutionary” will be granted Iranian citizenship. The MPs who tabled the bill on January 12 include several conservative parliamentarians who are currently waiting for their amendment to be reviewed.

Who does this new law affect and what is it really trying to achieve?

“After the Soviet Union invaded Afghanistan [in 1979], the government of the Islamic Republic of Iran opened its doors to Afghans, arguing that Islam does not recognize any borders,” explains Shirin Ebadi, an Iranian human-rights lawyer and 2003 Nobel Peace laureate. “At that time, around 4 million Afghans came to Iran, but only around 10 percent of them managed to obtain residency permits.” The rest, she explains, remained illegally, and were thus denied basic rights which citizens enjoy. “At that time,” Ebadi continues, “Iran had begun an eight-year war with Iraq and was naturally in need of inexpensive labor. Iran took advantage of illegal Afghan workers to satisfy this need.” But when the war ended, the policy remained.

The Iran deal is our best possible option. Let’s not spoil it: Heinbecker

Paul Heinbecker analyses the Iranian draft nuclear deal and concludes with the following sharp and pointed comment:

Finally, what can and should Ottawa do? Not much in Tehran, because with our embassy closed by the Harper government, we are blind, deaf, and dumb there. And as for Washington, we should just “zip it.” It would be an error in substance, and destructive of our wider interests, if we undermined the Obama administration vis-a-vis Iran, Israel or Congress. As regards Israel, we should not succumb to the temptation to play diaspora politics, even in an election year in Canada. We should, therefore, do nothing overtly to support Mr. Netanyahu, whose own election tactics destroyed whatever credibility he still had outside of Israel and the Republican side of Capitol Hill.

The Harper government has said little, but has announced a contribution of $3-million to support the IAEA’s efforts to monitor Iranian compliance. On an issue so fraught with dangers, such constructive circumspection is the beginning of wisdom. May it continue.

The Parliamentary Secretary for Multiculturalism Asks Iranian-Canadians “Why Are You Here?” | Susan Khazaeli

While the commentary goes a bit too far in its arguments that this language creates two classes of citizens, subconsciously it may reflect this belief.

And people come to Canada for both economic objectives and living in a country that respects political and human rights:

A Conservative Toronto MP, Chungsen Leung, recently attended an event organized by the Association of North American Ethnic Journalists and Writers. During the meet-and-greet, Mr. Leung was asked about the increasing difficulties faced by Iranians attempting to obtain a Canadian Visa. Emotions apparently ran high. At one point, in a heated exchange, Mr. Leung asked a member of the audience, “If you like Iran so much then why do you come to Canada?”

He then demanded to know: “Why are you here?” Some audience members were so offended by his comments and his dismissive attitude — which one attendee characterized as “arrogant” — that they decided to leave the event.

Mr. Leung is also the Parliamentary Secretary for Multiculturalism. It kind of sounds like a bad joke, doesn’t it?

According to a CTV report, Mr. Leung’s office claims that the exchange was a “miscommunication.” His email apology expressed regret for the misunderstanding. Perhaps Mr. Leung’s comments were off-the-cuff, but they were, by no means, innocuous.

Even if unintentional, Mr. Leung’s comments were discriminatory and hostile. The subtext of the messaging is: “Why don’t you go back where you came from?” They betray an underlying attitude that many non-white Canadians encounter when expressing views critical of government policy. This attitude becomes even more pronounced when that non-white Canadian comes from a country that, like Iran, is on the outs with Canada.

Liam Lacey’s TIFF diary: Jon Stewart rises above Gaza tensions in directorial debut

Nice discussion between Jon Stewart and Maziar Bahari at TIFF on their upcoming film, Rosewater, on Bahari’s imprisonment in Iran following his coverage of the Green Revolution and on the importance of storytelling:

Stewart is Jewish, and his occasionally critical views on Israel have earned him admiration among youth in the Arab world. Bahari was born in Tehran and educated in Montreal. His first documentary, The Voyage of St. Louis, is considered the first film by a Muslim about the Holocaust. On Sunday morning, as church bells were ringing outside, I asked them to talk about cultural bridge-building. They laughed.

“That’s where we met – right in the middle!” said Bahari with a laugh.

“In the middle of the Venn diagram where no one likes you,” Stewart added.

“It was never like: ‘Oh, I want to build cultural bridges. I want to change the world,’” Bahari reflected. “That was the beauty of working with Jon. He wasn’t some activist filmmaker. He has a sense of humour [and] saw it as a good story about family and family love. And then you had this important, political, historical, journalistic background.”

“I think that a good story, well-told, accomplishes those things without that being the goal of it,” Stewart said. “One of the biggest problems with activist work is that it values the activism above the art, and it can get in the way … You can’t create work with a goal in mind in regard to peoples’ reaction. The goal is to tell this really compelling story as best we can.”

I read And Then They Came for Me, Maziar Bahari’s recounting, as a Newsweek journalist, of Iran’s Green Revolution and his subsequent imprisonment.  Not as sophisticated as Haleh Esfandiari’s My Prison My Home, but lots of common insights into Iran, the interrogation process, courage and ways to keep one’s sanity, and the importance to international pressure to get them released. And with some wonderful asides on Leonard Cohen (his strongest Canadian connection), both his cynical side (Everybody Knows as Bahari realizes the election results will be fixed) and on the romantic or hopeful side (Sisters of Mercy which comes to him while in prison). Another strong, powerful and depressing account of today’s Iran.

 

U.S. investors begin to imagine a return to Iran – Washington Post

Not terribly surprising that US companies, like companies from other countries, are positioning themselves for a post-sanctions environment should the current nuclear talks lead to a deal:

“There will be phenomenal opportunities for American investors. I would definitely consider investing in Iran, and I think that’s the universal answer,” said Dick Simon, chief executive of RSI, a Boston-based real estate development and investment management company, who helped organize a recent trip to Iran composed of mostly U.S. entrepreneurs, as well as several who were Canadian or British.

In the absence of diplomatic relations, such contact can serve to de-escalate tensions between the two governments — which analysts say is a strategic goal for the administrations of President Obama and Rouhani — as negotiations over Iran’s controversial nuclear program are ongoing.“

An increasing number of Americans, both inside and outside government, understand the value of whetting the appetite of business people in Iran,” said Reza Marashi, research director at the National Iranian American Council NIAC.

According to Marashi, NIAC has been inundated this year by calls from Americans who want to travel to Iran. The organization, which favors greater contact between Americans and Iranians, is one of the few non-governmental entities in regular communication with officials in both governments.

As to Canada, still stuck in its standard “huff and puff” rhetoric, with no sign of change (see my earlier piece in the GlobeIf Iran opens for business, Canada will need a new approach – and fast).

Western women can learn from Islam – Anne Michaud

A bit of an odd piece on dress codes. Yes, the hypersexualization of the West in unhealthy, for both men and women, yet my sense, anecdotal, from my daughter and her friends, is that are strong young women, and have navigated the imagery successfully.

As to her comments about Iran, total ignorance. A thousand people demonstration  in Tehran, a city of more than 10 million, is a rounding error:

Women in full burqas and hijabs poured into Tehran’s streets last week to protest the modern dress of their urban sisters. City women usually nod to the conservative religious dress code by wearing knee-length coats and head kerchiefs in public. But earlier this month, several dared to bare their full heads and faces for a photograph.

So, the protesters — about 1,000 women and men — appealed to Iran’s morality police to better enforce the law, which obliges women to cover their hair and much of their bodies in loose clothing when outside, regardless of their religion.

As I studied the images of the mob of black-cloaked women, I thought we could use more public modesty ourselves.

As I see it, the hijab head covering and burqa cloak are symbols of subservience. They erase individuality, represent hostility to girls’ education and independence, and press unique souls into one narrow feminine role.

And yet, I wonder whether the same couldn’t be said about a culture that turns a Hannah Montana into a twerking, crotch-rubbing wrecking ball.

On Exile from “The Neighbour” – Short Story by Goli Taraghi

A collection of her short stories was given to us over the holidays by a family friend. She captures very well the experiences of many before and after the Iranian Revolution, but my favourite paragraph is the following on exile:

All of us – my children, the friends who occasionally visit us, I myself – are scared stiff of the downstairs neighbour. Our lives as foreigners in Paris are full of hidden anxieties. To begin with, we feel guilty for having taken up space that rightfully belongs to the natives, yet hidden beneath our apologetic smiles and submissiveness lurks an anger that stings and lies in wait for revenge. Humiliated, we painfully swallow our pride – a pride that has been instilled in us over the past two and a half millennia, a confidence that we descendants of Cyrus the Great, even in defeat and despair, are superior to the rest of the world (why, God only knows), and if we have fallen on hard times if little is left of our past glory and splendour, you Western exploiters are too blame.

While different exile communities may describe their experience somewhat differently, there are some universal experiences of exiles, and coming to terms of their fate. My mother’s family left Russia shortly after the 1917 revolution, and likely had some comparable feelings (although they likely did not blame Westerners!).

Sanctions Eased, Iran Gets Feelers From Old Trading Partners – NYTimes.com

Further to my piece in the Globe If Iran opens for business, Canada will need a new approach – and fast, a reminder that with the interim deal being implemented, business communities of other countries are starting to position themselves should the deal hold and continue to next stages. Of course, chances of medium-term success are small, given that the hard issues remain to be addressed (see the solid analysis in The Economist Some supporters of the Iran deal doubt there will be a long-term pact):

Many multinationals have long eyed what they view as the virgin Iranian market, where many highly educated consumers are thirsty for jobs and Western products. Iran’s infrastructure, including that of its oil industry, needs a complete overhaul.

“We need over $200 billion investment in our oil and gas sector alone,” said Saeed Laylaz, an economist close to Mr. Rouhani’s government. Iran needs multibillion-dollar injections in its heavy industries, its transportation sector and airlines, he said. “On top of that, we need to acquire new management skills and services. Basically, we need everything the other emerging nations needed a decade ago.”

If Iran opens for business, Canada will need a new approach – and fast – The Globe and Mail

Not part of my usual posts in this blog, but an opinion piece for The Globe and Mail on Canada’s relations with Iran. As this is behind a pay wall, text below:

Twenty five years ago, I arrived in Iran as part of the team that reopened our Embassy in Tehran, which had closed for some eight years following the escape of the Americans that had sought refuge with Canada. Following the end of the Iran-Iraq war in 1988, we had essentially been invited by the Iranian government, in part because of their interest in having access to North American oil and gas technology.

Given all the current commentary, for and against the Iran nuclear interim agreement, it is useful to think ahead about some of the possible implications for Canada about its current rhetoric on Iran in general, and the agreement in particular. We do not know whether the agreement will be implemented – both the U.S. and Iran have difficult domestic constituencies to deal with, and Ronald Reagan’s expression, “trust but verify” clearly applies and is shared by all parties to the agreement.

But should the agreement be implemented, and lead to either a series of further agreements or a final agreement, Canada should be prepared for that possibility. In that light, while the government and Foreign Minister John Baird have, in their terms, dialled down the rhetoric somewhat – and Iran is sophisticated enough to pick up on this – the government should develop an exit strategy for its current approach to Iran.

This is not unprecedented. The Conservative government started off with strong rhetoric on China, focussing on human rights, not trade, and was forced, given Canadian interests, to refocus on trade. Similarly, the government’s harsh rhetoric in 2012 over the Palestinian Authority’s statehood bid at the UN was similarly toned down following the renewed U.S. peace plan initiative, given that it was counterproductive for our relations with Israel, the United States and the PA.

The unveiling last month of the Global Markets Action Plan, focussing diplomatic efforts on economic diplomacy, suggests that “principles-based” foreign policy is either becoming an empty slogan, or at least only applicable to markets of marginal importance to Canada.

Should the interim agreement hold, and be followed by subsequent agreements further relaxing sanctions, Canada will need to review its sanctions policy to ensure that Canadian firms are not disadvantaged in comparison to our competitors. In contrast to 1988, when one of the main incentives for Iran was that Canada offered North American oil and gas technology without going through the United States, any removal of Canadian sanctions would likely be in lock-step with U.S. policies, with Canadian firms having no special advantages.

But easing of sanctions, without a coherent foreign policy aligned to our economic interests, is unlikely to be enough. We can expect pressure from the Canadian business community, particularly from Alberta oil and gas equipment suppliers, to ensure a level playing field, not only on the easing of sanctions, but on the broader foreign policy front.

The elements are not complex in theory, but are in practice:

Further dialling down of rhetoric on Iran.

Yes, prudence is required, but “huff and puff” language is unhelpful. Language used by the U.K. and U.S. strikes the right tone between giving space for the interim agreement while expressing appropriate caution;

Some public recognition that there are signs of change in Iran’s approach.

Yes, these are tentative, and yes, given the complexity of the Iranian regime’s internal politics, the messages are mixed, but most Iranians, both inside Iran and in the diaspora, understand the significance of Hassan Rouhani’s election. We should too.

Use our strong relationship with Israel to encourage Israel to tone down its rhetoric and reflect some of the more nuanced discussion within Israel itself.

While Israeli fears and caution are legitimate, the language and approach appears to have been largely counterproductive in shaping the US and world approach to Iran.

Start informal discussions with the Iranian government on normalization of relations.

We may have closed our Embassy but as the U.S. and others have shown, that does not preclude discussion. These informal discussions should allow us to follow the U.K. lead in reopening its Embassy in Tehran. The standard diplomatic caution of starting with representation at the chargé d’affaires level, as we did in 1988, reinforces the “trust but verify” of the interim agreement.

At present, we do not know if the interim agreement will be implemented, given all the internal and external constraints. However, to be prudent, the government should be prepared for the possibility that the interim agreement will succeed, and lead to further agreements. Given our economic interests, particularly in Alberta, and the sizeable Iranian Canadian community, sooner or later, we will likely be forced to move in that direction. Better to start preparing now and send appropriate signals now.
